1. Parties and scope

These Terms of Use (“Terms”) govern the use of the PEKO mobile app (“PEKO” or the “app”).
PEKO is developed and provided by Sercan Göger, an individual (“Developer”, “we” or “us”). Sercan Göger uses Corylustech as a trade name and brand. Corylustech is not a separate legal entity. “PEKO” and “Peko Games” are brand names.

“You” means the parent, guardian or legal representative who accepts these Terms, or a person aged 18 or over who uses PEKO for themselves. “Child” means a person under 18 who uses PEKO under your supervision.
The Privacy Policy and Children and Families form an integral part of these Terms.

2. Acceptance, capacity and parental acceptance

Under Turkish law, persons under 18 are minors. A parent with parental authority or a guardian acts on a minor’s behalf (Turkish Civil Code).
For every user under 18, these Terms are therefore accepted by a parent, guardian or legal representative. Users aged 18 or over accept them for themselves.
Acceptance happens during Grown-up setup with a single confirmation after the documents are made available. The age group, version, time and acceptance flags are stored on the device. Usage statistics are a separate optional choice.
By accepting, you confirm that: you are 18 or over and have legal capacity; you are the child’s parent, guardian or legal representative, or you use PEKO for yourself; you have read these Terms and will make sure the child uses PEKO in line with them.
A parent or guardian should accept on behalf of a minor. A child completing the setup alone is a breach of these Terms.
If you do not accept these Terms, do not use PEKO and uninstall it.

3. What PEKO is and what this version does not include

PEKO is a creativity app with drawing, world building, stories, courses, Drawing School (letter and picture tracing), augmented reality (AR) and a discovery camera. It works without the internet.
This version has no accounts, no sign-in, no cloud saving, no sync, no community (sharing or browsing) and no AI world creation. These may appear in the app as “coming soon”.
If any of these features is introduced, we will update the documents, notify parents in the app and ask for verifiable parental consent as the law requires before the feature can be used. Separate rules will apply to those features.
PEKO has no chat, messaging, comments, friend lists or other social features.

3.1 Optional AI 3D, where offered

Some builds offer a separate parent-connected AI 3D service. It requires internet access, a provider account and API key, a parent PIN, the separate choices explained in Privacy Policy section 7.6, and an enabled provider. This is not PEKO account registration or cloud saving. Builds without this feature make no such provider requests.

The external provider can charge for generation, including a request that cannot be cancelled. PEKO does not sell those credits or guarantee a refund. Daily/weekly limits apply to activity counted on this device, not the provider account’s total spending; use the provider’s own limits too. Do not give API keys to children or send them to support.

Provider age restrictions, content rules and rights in generated models apply. Generated content may be inaccurate, unsuitable or not protected by copyright; review it before a child uses or shares it. No exclusive rights or commercial clearance are guaranteed. A local parent check does not replace legally required parental-consent verification or make a prohibited provider use permissible. This feature must remain unavailable in a child-directed release until its applicable requirements are satisfied.

Removing a connection stops new submissions and removes the local key, but does not cancel every accepted job, erase provider records or remove downloaded models. See the Privacy Policy and Data Deletion page before connecting a service.

4. Free: no ads and no purchases

PEKO is free. There are no PEKO ads, in-app purchases or subscriptions. Optional third-party AI 3D generation can use the parent’s separately purchased provider credits; see section 3.
We do not use advertising IDs and we do not track users across apps.

If we ever consider adding ads or a paid feature:

We will announce it in advance in the app and on pekogames.com.
We will update these Terms and the Privacy Policy and ask the parent to accept them again.
We will never show personalised or behavioural ads to anyone under 18.
We will offer nothing to children under 13 beyond what the law allows.
We will place every purchase behind the parental gate and the app store’s own parental approval.

Such a change does not take effect on a device until the parent accepts it again.

5. Responsibilities by age group

PEKO is designed primarily for ages 6–12, with ages 6–8 at its core. A store’s content rating is not proof of a child’s ability to use every feature without support.

Age group	Setup and guidance
Under 13, or age skipped	Adult check and parent PIN required. A parent or guardian accepts the terms and manages permissions. Younger children need close help with written instructions and cameras.
13–17	Parent or guardian acceptance remains required. A PIN is offered and can be skipped; choosing a PIN is recommended on a shared device.
18+	The adult accepts for themselves. A new parent PIN is not required. Any existing PIN stays in place.

These differences concern local controls, not online data permissions. Every age group keeps the same privacy defaults. The maths check and PIN are not identity verification or legally verifiable parental consent.

Parents decide on optional microphone use, usage statistics, exports and sharing, and supervise camera and AR activities according to the child’s needs. A PIN does not encrypt local files or replace device security.

Teachers may use PEKO for non-commercial classroom activities subject to school rules and any necessary parental permission. There are no class accounts, student dashboards or school-specific contracts in this version. On shared devices, remove student content after the activity and do not share it without authority.

6. General responsibilities of parents and guardians

You are responsible for how, when and for how long the child uses PEKO.
You are responsible for who holds the device, for the security of the device (screen lock, operating system updates) and for the other apps on it.
Keep the parent code secret and enter it where the child cannot see. If the child learns the code, change it in the parent area.
You decide on the microphone, exports, usage statistics and sharing.
Backing up important creations is your responsibility (section 13).

7. Licence to use PEKO

Provided you comply with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to use PEKO for personal, family and non-commercial classroom purposes on devices you own or are authorised to control.
The licence covers family sharing as permitted by the app store’s rules.
PEKO is licensed, not sold, to you. All rights not expressly granted remain with us or our licensors.

8. Restrictions

When using PEKO, you may not:

copy, sell, rent, distribute or sublicense PEKO or any part of it, or use it for commercial purposes;
decompile, reverse engineer or modify it, except where the law expressly allows (for example for interoperability);
bypass or try to bypass the parental gate, security measures or technical protections;
send excessive or automated requests to our server, or try to disrupt its operation;
use PEKO for unlawful purposes or in a way that infringes the rights of others (such as privacy or copyright);
use PEKO’s brands, logo or characters for commercial purposes without permission.

9. Intellectual property

The PEKO software, name, logo, mascot and characters, artwork, animations, music, sounds, texts and other content belong to the Developer or its licensors. They are protected by copyright, trademark and other intellectual property law.
PEKO uses some third-party and open-source components and sound libraries under their own licences. Sound sources and licence notices are shown in the app in Parent area → Info → Sound sources and licences. These components are subject to their own licence terms.
If you send us suggestions or feedback, we may use them to improve PEKO without any obligation to you. Feedback that contains personal data is processed under the Privacy Policy.

10. Your child’s creations

The drawings, worlds, stories and voice recordings a child makes in PEKO (“creations”) remain with their creator or other lawful rights holder to the extent intellectual property rights arise. Parental responsibility does not itself transfer a child’s copyright. Our rights in the PEKO characters, templates and sounds used in creations remain with us.
You may keep, show and share creations for personal, non-commercial purposes, even if they include PEKO characters.
Creations are stored locally and are not sent to PEKO servers. If enabled in your build, parent-connected AI 3D sends a selected drawing directly to that provider; its terms and privacy policy apply.
You grant us no licence in creations. The only exception is the use technically needed for the app to store, display and process creations on your device.
If a sharing feature is introduced in the future, separate consent and separate rules will apply.
If you share creations outside the device (for example an AR photo), you are responsible for that sharing and for respecting the rights of others.

11. Health and safety

These warnings are general information and not medical advice. If you have a concern, ask a health professional.

11.1 Supervision, screen time and breaks

Supervise the child in a way that suits the child’s age (section 5).
In Parent area → Control you can set a daily time limit and a break reminder, and in Weekly summary you can see the last 7 days. The child sees a warning 5 minutes before the time ends and a rest card when it ends.
Avoid long, uninterrupted sessions and take regular breaks. Limit use right before bedtime.

11.2 Photosensitivity (epilepsy) warning

A very small number of people may have a seizure when exposed to visual stimuli on a screen, such as flashing lights, colour changes or patterns. This can happen even in people who have never had a seizure.
If you or anyone in your family has a history of epilepsy or seizures, consult a doctor before using PEKO.
Stop using PEKO immediately and see a doctor if you notice dizziness, changes in vision, eye or face twitching, involuntary movement of arms or legs, disorientation, confusion or convulsions. Children cannot always notice or describe these symptoms; watch them.
To reduce the risk: play in a well-lit room, do not sit too close to the screen, do not play when tired or short of sleep, and take regular breaks.

11.3 AR and discovery camera: physical safety

PEKO shows a safety reminder at the start of the AR section.
Look around before playing. Choose a clear, open and safe area.
Young children should always have an adult with them.
Do not use AR or the discovery camera while walking, near roads or traffic, on stairs or balconies, near pools or water, or near hot or dangerous objects.
Remember that you cannot see your surroundings while looking at the screen. Take care not to bump into objects, people or animals.
If you feel dizzy, sick or have tired eyes, stop and rest.
On Android, AR requires Google Play Services for AR and may not work on every device.

11.4 Camera, photos and other people’s privacy

Ask for permission before taking someone’s photo or including them in an AR photo.
Follow the rules at school, in other people’s homes and in public places. Do not use the camera in private areas such as bathrooms or changing rooms.
The discovery camera does not identify anyone and does not save images.
AR photos stay on the device. Before sharing, check whether the photo shows the child’s face, name, school, home or other people.

11.5 Microphone

The microphone is off by default. Only a parent can turn it on, and the device also asks for permission.
Recordings last at most 10 seconds and stay on the device. They are included in the backup files the parent creates.
Tell the child not to record other people without permission and not to say their name, address or phone number in recordings.

11.6 Volume and hearing

Keep the volume at a reasonable level, especially with headphones.
We recommend using your device’s headphone volume limit and similar hearing protection features.

11.7 Young children and devices

Use the device with a sturdy case and take care to avoid drops.
Do not leave young children unsupervised while the device is charging or hot.
Keep cables and accessories out of reach of young children.

12. Content, recognition and learning

Drawing recognition and object discovery run automatically on the device and can be wrong. Results are only suggestions.
PEKO’s content is for entertainment and creativity.
Drawing School is a practice tool that makes letter and picture tracing fun. It does not replace school education, a teacher or professional support (for example occupational therapy or speech and language therapy).
The direction and order of letter strokes may differ from what the child learns at school. In that case, follow the teacher’s method.
We do not guarantee any particular learning outcome.
Read-aloud uses the device’s speech engine; pronunciation may not always be correct.

13. Your data is on your device: backups and data loss

Creations and settings in PEKO are stored only on the device. Uninstalling the app, resetting the device, or losing or breaking the device can delete this data.
If the operating system backup is on, it covers only PEKO’s main database. Voice recordings, AR photos and exports are not included in that backup.
You can back up important worlds in Parent area → Worlds and backups and keep the files in a safe place.
Because we do not hold your data, we cannot restore lost data.
To the extent the law allows, we are not responsible for data loss. This limitation does not apply to loss caused by our intent or gross negligence.

14. Availability, updates and third-party platforms

We may change, add or remove PEKO’s features. We may suspend PEKO temporarily or discontinue it entirely. Where possible, we announce important changes in advance in the app or on pekogames.com.
We recommend installing updates for bug fixes and security. Some features may require an update.
The oldest supported operating system versions are shown on the store page. We do not guarantee that PEKO, especially AR, will work on every device.
Most of PEKO’s features work without the internet.
Apple, Google, the device’s speech engine and Google Play Services for AR are not under our control. Their own terms apply, and we are not responsible for their interruptions or changes.

15. Disclaimer of warranties

PEKO is provided free of charge. To the maximum extent permitted by law, PEKO is provided “as is” and “as available”.
To the maximum extent permitted by law, we give no express or implied warranty that PEKO will be uninterrupted, error-free or free of viruses, fit for a particular purpose, that recognition results will be accurate, or that it will achieve any particular learning outcome.
Rights you have as a consumer that cannot be excluded by contract are not affected.

16. Limitation of liability

Our responsibility is determined by applicable law. Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury where liability cannot lawfully be excluded, or mandatory consumer and product-liability rights.

Where the law permits, we are not responsible for loss caused solely by misuse contrary to clear safety instructions, third-party services outside our control, or events we could not reasonably prevent. This does not excuse a failure to exercise legally required care.

No automatic monetary cap is imposed on your statutory claims. If mandatory rules in your country offer stronger protection, those rules apply.

17. Misuse and legal responsibility

We do not impose a blanket duty on families to indemnify us for a child’s ordinary use. Deliberate infringement or unlawful misuse may have consequences under applicable law. A parent is not made responsible for every act of a child merely by accepting these Terms.

18. Termination

You can end these Terms at any time by uninstalling PEKO.
Your licence ends automatically if you materially breach these Terms.
If we discontinue PEKO, we will announce it in advance where possible. The app on your device may keep working as it is but may no longer receive updates.
When the licence ends, stop using PEKO and uninstall it. Data on the device is deleted when the app is uninstalled.
Sections 9, 10, 13, 15, 16, 17, 20 and 22 survive the end of these Terms.

19. Changes to these Terms

We may update these Terms. We announce changes in the app and publish them on pekogames.com. The current version is shown at the end of the document.
For material changes, we ask the parent to read and accept the documents again at the next launch.
Minor changes, such as typo fixes or clarifications, take effect when published.
If you do not accept a change, stop using PEKO and uninstall it.

20. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye.
If you have a problem, please first write to privacy@pekogames.com. We will try to resolve it together.
The courts and enforcement offices at the Developer’s place of residence have jurisdiction over disputes. This does not affect cases where the law makes another place exclusively competent or competent in favour of the consumer.
If you are a consumer in Türkiye, for disputes under Law No. 6502 you can apply to the consumer arbitration committee at your place of residence within the monetary limits, and above those limits, after the mediation process required by law, to the consumer court at your place of residence.
If you are a consumer living in the EU, the UK or another country, you benefit from the mandatory consumer protection rules of the country where you live and from your right to bring proceedings in the courts of your own country.

21. Apple- and Google-specific terms

21.1 Apple App Store

If you downloaded PEKO from the Apple App Store, the following also applies:

Parties: These Terms are between you and the Developer, not Apple. The Developer, not Apple, is responsible for PEKO and its content.
Scope of licence: The licence is non-transferable and limited to using PEKO on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts associated with you through Family Sharing or volume purchasing may also access PEKO.
Maintenance and support: Only the Developer provides maintenance and support for PEKO. Apple has no obligation to provide any maintenance or support for PEKO.
Warranty: If PEKO fails to conform to any warranty that has not been disclaimed, you may notify Apple, and Apple will refund the purchase price, if any. Because PEKO is free, this amount is zero. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to PEKO.
Product claims: The Developer, not Apple, addresses any claims by you or a third party relating to PEKO, including product liability claims, claims that PEKO fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation.
Intellectual property: If a third party claims that PEKO or your use of it infringes that third party’s intellectual property rights, the Developer, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance: You represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
Developer name and address: Send questions, complaints and claims to: Sercan Göger (Corylustech), Turgut Reis Mahallesi, Karaosmanoğlu Caddesi, Esenler / İstanbul, privacy@pekogames.com. The pre-release operator telephone contact remains to be completed in the Privacy Policy.
Third-party terms: When using PEKO, you must comply with applicable third-party agreements (for example the terms of your device or mobile data service).
Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

21.2 Google Play

If you downloaded PEKO from Google Play, the Google Play Terms of Service also apply. Google is not a party to these Terms and is not responsible for PEKO.
Family sharing permitted through Google Play Family Library is included in the licence under these Terms.
Google Play Services for AR, used for AR on Android, is subject to Google’s own terms.

22. General provisions

Entire agreement: These Terms, together with the Privacy Policy and Children and Families, form the entire agreement between us regarding PEKO.
Severability: If a provision is found invalid or unenforceable, it is applied in the valid way closest to its purpose, and the other provisions remain in force.
Assignment: You may not transfer your rights or obligations under these Terms. The Developer may transfer PEKO and these Terms to a company he sets up or to another successor; this does not reduce your rights and will be announced in the app beforehand.
No waiver: If we do not exercise a right, or exercise it late, this does not mean we have waived it.
Notices: You can send notices to us at privacy@pekogames.com or to Turgut Reis Mahallesi, Karaosmanoğlu Caddesi, Esenler / İstanbul. Because we hold no contact details for you, we give notices to you in the app and on pekogames.com.
Force majeure: We are not liable for failing to meet our obligations because of events beyond our reasonable control, such as natural disasters, epidemics, war, terrorism, strikes, cyberattacks, power or internet outages, outages at third-party service providers and decisions of public authorities.
Language: These Terms are prepared in Turkish and English. The Turkish text governs for users living in Türkiye, and the English text governs for all other users. Explanations shown in other languages on the website are for information only.
Headings: Headings are for ease of reading only.
